Patent application

Once your invention has been claimed by the university, we – together with experienced patent attorneys – start drafting the patent application.

Your involvement is crucial

You receive drafts for review; we seek your technical feedback and clarify open points directly with you. The faster and more concrete your input, the more quickly and accurately we can draft the application. That way you ensure your invention is captured correctly, claimed strongly, and protected on time.

Mind the timeline

Standard case

Duration

Total duration about 6–8 weeks: after the claim declaration, the first draft is produced, followed by 1–2 feedback rounds and final drafting of claims, drawings, and description.

Special case: urgent matters

Dauer

Filing possible in 3–4 weeks if documents are complete and coordination is swift.

Actual duration depends heavily on your involvement: the faster you answer questions, provide data and sketches, and approve drafts, the sooner we can file. Complexity of the invention and the volume of experimental data also affect the schedule.

Tip

Get in touch early and state desired conference or publication deadlines – then we can pace the process optimally.

The BAYPAT Erfindungscheck is a practical step-by-step guide from the Bavarian Patent Alliance – for researchers and anyone supporting inventions in a university context.

In three interactive modules, you'll learn how to classify an invention, describe it clearly, and what matters after disclosure in the patenting process – with the guiding principle: clarify protection first, then publish.
